SMS TERMS AND CONDITIONS

These SMS Terms and Conditions (“SMS Terms”) govern the text messaging program operated by Maria Daniela Dias Rodrigues PA (“we,” “us,” or “our”). By opting in to receive text messages from us, you agree to these SMS Terms and our Privacy Policy.

  1. PROGRAM DESCRIPTION

The Maria Daniela Dias Rodrigues PA SMS program may send marketing, informational, and service-related text messages concerning:

• New developments and pre-construction opportunities;

• Miami real estate market updates;

• Price, inventory, and project updates;

• Appointment and showing reminders;

  1. HOW TO OPT OUT

You may withdraw your consent and stop receiving marketing text messages at any time by replying:

STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or OPT OUT.

After submitting an opt-out request, you may receive one final text message confirming that your request has been processed. No additional marketing text messages will be sent unless you provide consent again.

You may continue to receive nonmarketing communications when necessary to respond to a request you initiated, provide a requested service, or comply with legal or transactional obligations.

  1. ELIGIBILITY AND AUTHORITY

You must be at least 18 years old or have the permission of a parent or legal guardian to participate in the SMS program.

By enrolling, you confirm that:

• You are the subscriber or customary user of the mobile number provided;

• You are authorized to consent to receive text messages at that number;

• The information you provide is accurate; and

• You will notify us if the number changes or is reassigned.

If your mobile number changes or is transferred to another person, you must opt out or notify us promptly.

  1. SUPPORTED CARRIERS AND MESSAGE DELIVERY

Our text messaging program may not be available through all wireless carriers or on all devices. Message delivery is subject to the effective transmission of messages by your wireless carrier and other network providers.

Wireless carriers are not liable for delayed or undelivered messages. We do not guarantee that every message will be delivered or received within a specific period.

  1. PRIVACY AND MOBILE INFORMATION

We do not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent records with third parties or affiliates for their own marketing or promotional purposes.

We may disclose mobile information to service providers and subcontractors that help us operate and support the messaging program, including telecommunications providers, messaging platforms, customer relationship management providers, and technology vendors. These providers may use the information only to perform services on our behalf or as required by law.

SMS opt-in data and consent will not be shared with third parties for purposes unrelated to providing the services associated with the messaging program.

  1. SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, text messages and electronic communications cannot be guaranteed to be completely secure.

Do not send sensitive financial information, account passwords, Social Security numbers, wire instructions, or other confidential information by text message.

Always independently verify wire instructions and other sensitive transaction information using a trusted telephone number before taking action.

  1. NO GUARANTEE OF AVAILABILITY OR INVESTMENT PERFORMANCE

Text messages concerning properties, developments, pricing, availability, incentives, rental policies, or deposit structures are provided for general informational purposes and may change without notice.

Property availability and terms must be independently confirmed. Nothing sent through the SMS program constitutes a guarantee of availability, appreciation, rental income, investment performance, or return on investment.

  1. CHANGES TO THE SMS PROGRAM OR THESE TERMS

We may modify, suspend, or discontinue the SMS program or update these SMS Terms at any time, subject to applicable law.

Updated terms will be posted on this page with a revised “Last Updated” date. Your continued participation in the program after an update constitutes acceptance of the revised terms to the extent permitted by law.

  1. TERMINATION

We may suspend or terminate your participation in the SMS program if we believe you have violated these SMS Terms, provided inaccurate information, misused the program, or engaged in conduct that may harm us, our service providers, or other users.

Your obligations under these SMS Terms that reasonably should survive termination will remain in effect.

  1. GOVERNING LAW

These SMS Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.
